What is a Patent?

Welcome to Idea Next Step.Com

A patent for an invention is the grant of a property right to the inventor, issued by the Untied States Patent and Trademark Office. Generally, the term of a new patent is 20 years from the date of which the application for the patent was filed, subject to the payment of maintenance fees. U.S. patent grants are effective only within the United States, U.S. territories, and U.S. possessions. Under certain circumstances, patent term extensions or adjustments may be available.

A U.S. patent grants you the right to exclude others from making, using, offering for sale, or selling the invention in the United States or importing the invention into the United States. The patent holder is responsible for maintenance fees to keep it active, and the patent holder is responsible for enforcement.

The cost of patent filing fees vary depending on the type of patent application you submit, and according to the way you claim your invention. Please discuss these details with your patent attorney before proceeding. There are various fees associated with filing your application, and there are maintenance fees necessary to maintain the legality of your patent. Typically the cost to file a United States patent will range from $3000.00 to $6000.00 dollars for a professional high quality patent application. This includes your attorney fees, filing fees, professional patent search and patent drawings.

If you seek additional patent protection outside the United States and its U.S. territories, you must then apply for patent in the specific countries which you’re seeking patent protection. For more information on foreign patents, please see the Foreign Patents and Treaties tab listed under Patents.
